These Terms of Service ("Terms") govern your access to and use of Fluxshield's website and security intelligence platform (the "Services") provided by Fluxshield, Inc. ("Fluxshield"). By accessing or using our Services, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account or using the Services, you represent that you are at least 18 years old, have the authority to bind your organization to these Terms, and agree to comply with all applicable laws and regulations. If you do not agree to these Terms, do not use the Services.
License and Permitted Use
Subject to these Terms and payment of applicable fees, Fluxshield grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business security purposes. You may not: sublicense, resell, or distribute the Services; reverse engineer or attempt to extract source code; use the Services to monitor individuals without lawful authority; or use the Services in any manner that could damage or impair Fluxshield's infrastructure.
Subscription, Payment, and Cancellation
Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law or as specified in your order form. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Fluxshield reserves the right to modify pricing with 30 days' notice.
Data Ownership and Security
You retain all rights to your data. Fluxshield processes your data solely to provide the Services as described in our Privacy Policy and Data Processing Agreement. We maintain industry-standard security controls including SOC 2 Type II certification and ISO 27001 accreditation to protect your data.
Limitation of Liability
To the maximum extent permitted by law, Fluxshield shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim. Some jurisdictions do not allow limitation of liability for certain types of damages, so these limitations may not apply to you.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court for intellectual property matters.
